Consumers trust that the products that they buy are safe.  However, each year many consumers are hurt by unsafe products.  Unknowing consumers may purchase products that malfunction or that contain dangerous materials, for example.  Many dangerous products are recalled each year by the Consumer Product Safety Commission, the federal agency responsible for unreasonable risks of serious injury or death from products under its jurisdiction.

Types of Defective Products

In recent years, the following types of products have been found to be defective and dangerous:

  • Defective Toys:  recently, defective toys have caused eye injuries, burns, eye injuries, strangulation, choking, exposure to toxic substances and fatalities.
  • Defective Cribs:  defective cribs have lead to strangulation and falls that result in significant head injuries, broken limbs and fatalities.
  • Defective Tools: defective tools such as snow blowers and lawn mowers have caused limb injuries that require amputation, for example; and
  • Common Household Products: such as chemicals, window coverings, and appliances have also caused significant injuries.

You may be able to recover damages for injuries caused by these, or other, products by filing a products liability lawsuit.  The lawsuit will allege that a manufacturing defect, a design defect or  a marketing defect (failure to warn of danger) caused your injuries.

Defective Product Lawsuits

The first step in filing a defective product, or product liability lawsuit, is to contact a lawyer.  Your lawyer will help you investigate the product’s history and defect.  For example, your lawyer will determine if the product was on the recalled products list of the Consumer Product Safety Commission (CPSC).  If you were sold a product on the CPSC recalled products list then the retailer who sold you the product may be liable for damages, along with the manufacturer, distributor and other potential defendants.
