Zicam Recall and Lawsuit

zicam is a series of cold and allergy drugs whose ingredients include the use of the element zinc to help users rid themselves of a cold or allergy symptoms. Zicam LLC owns and distributes the drug Zicam and is a wholly owned subsidiary of Matrixx Initiatives Inc. Matrixx Initiatives Inc. is a United States over the counter drug company that sells their drugs without the required prescription. The United States Food and Drug Administration told consumers not to use the intranasal versions of Zicam Cold Remedy because of a risk to the user’s sense of smell. This warning was released in 2009 and it forced Zicam to remove the product from the market.

The Drug Zicam

The drug Zicam has been used by consumers in the United States market to remedy cold symptoms and allergy symptoms for quite some time now but the recent warning from the Food and Drug Administration has caused consumers to stop using certain Zicam products. The products affected by the warning are Zicam Cold Remedy Nasal Gel and Zicam Cold Remedy Gel Swabs. These products can be disposed of by the consumer, exchanged for a Zicam Cold Remedy Oral medication, or returned for a complete refund.

Affects of Zicam on Consumers

The use of the drug Zicam in the capacity of nasal medications has caused some consumers problems with their sense of smell, sometimes causing permanent damage to their sense of smell. The loss of smell is known as anosmia and it has affected over 300 consumers since at least the year 2006. The Food and Drug Administration claims that they have received at least 130 consumer complaints since 1999 about the drug Zicam and its side effects on its users. The manufacturer of Zicam, Matrixx Initiatives, settled roughly 340 lawsuits in January of 2006 dealing with people who claimed they suffered from anosmia because of Zicam. Some users of Zicam lost their sense of smell and even their sense of taste after just one use of the drug.

The Cost of the Lawsuit

Matrixx Initiatives has had to shell out over $12 million in legal fees defending its flagship product, which debuted in 1999. Since its debut, Zicam has sold over 10 million bottles. Only one Zicam lawsuit went to trial prior to the 340 case settlements offered by the company. This trial involved a 42-year-old Los Angeles computer consultant. Matrixx Initiatives also paid out $12 million dollars dispersed among the 340 lawsuits settled regarding Zicam.

Remove Zicam from the Closet

The drug Zicam should be removed from the medicine cabinet or closet of anyone that has purchased this drug in the Cold Remedy Nasal forms. There are also Cold Remedy Nasal medications available from Zicam for children. These medications should also be thrown away or sent back to Matrixx Initiatives for a full refund for the product. The loss of smell and sometimes the loss of taste might never come back for some consumers using Zicam Cold Remedy Nasal medications. There have been a couple of cases where the consumer has regained his or her sense of smell only to lose it again not long after regaining the sense.

Seeking Treatment

If you or a loved one has used any of the Zicam Cold Remedy nasal products that have been recalled from the market by Matrixx Initiatives you should seek medical treatment immediately. A doctor will be able to perform a thorough examination of the person that has used the drug, hopefully determining whether the patient has suffered any long-term problems with their sense of smell.

Legal Help

Once a medical examination has taken place and the doctor has determined that the patient has suffered a loss of their sense of smell, he or she should contact an attorney immediately to begin building a lawsuit against Matrixx Initiatives.
