In 2006, the orthopedic medical device manufacturer known as Zimmer Holdings, Incorporated, started to sell the “Durom Acetabular Hip Replacement Component,” also known as the “Durom Cup” in the United States.  The Durom Cup was introduced as an artificial hip replacement component, designed for use in young patients who would typically outlive a conventional hip prosthesis.

In April of 2008, a pre-eminent orthopedic surgeon and paid Zimmer consultant publically advised the American Association of Hip and Knee Surgeons of the fact that his patients were having a significantly high device failure rate with the Durom Cup, cup loosening following surgery and that his patients were sustaining substantial injuries which required revision surgery to correct the injury incurred due to the use of the Durom Cup

Following Dr. Dorr’s formal filing of his complaint, Zimmer performed its own internal investigation, but continued to sell the Durom Cup.  In late 2008, Durom stopped selling the Durom Cup in the United States as well as continuing investigational clinical trials in hip resurfacing procedures.  Zimmer did not actually issue a recall of the Durom Cup, but rather issued a statement by its President and CEO David Dvorak, which indicated “U.S surgeons…should stop implanting the Durom Cup until we issue the updated labeling that provides more detailed guidance on surgical technique, and until they receive training.”
