Strict Product Liability

Strict product liability refers to the legal theory that a manufacturer of a product, as well as a seller, distributor, and /or designer, is liable, or legally responsible, for any injuries that result to consumers from using the product. The social policy behind the theory of strict liability is that companies or manufacturers, rather than individual consumers, can better afford the risk of catastrophic losses or injuries. While companies can obtain insurance to cover claims relating to defective products, and then pass on a portion of those costs to consumers who purchase the products by increasing their prices to compensate for paying to maintain insurance coverage, all parties effectively share the burden of the risks of defective or unreasonably dangerous products. As a result of this social policy, manufacturers are liable for any injuries or harm that occurs as a result of a consumer using their products, no matter if they had any ill intent, or acted negligently, or not.
