Strict Liability Product

Strict liability in product liability cases means that if you are injured or harmed as a result of using a product, the manufacturer is responsible for compensating you for your losses. In some cases, the seller, renter, and/or distributor of a product may also be liable for your injuries caused by the product, but only if they were in the regular business of selling, renting, and/or distributing that particular type of product. Therefore, a person holding a garage sale or operating a thrift store that sold a variety of different types of items probably would not be liable for selling an item that ultimately caused harm to a consumer, although the manufacturer of the product would likely still be liable for the consumer's injuries. Therefore, while more than one party may be potentially liable for damages caused by a product under a strict liability theory, it is far more likely that a product's manufacturer will be liable for the damages, rather than a seller, renter, or distributor of the product, although liability for those parties may occur in some circumstances, as well.
