Products Liability Act

All states have enacted some sort of products liability act that covers cases where a consumer has been injured or suffered harm as a result of using a consumer product. These laws are state-specific, and govern when and under what circumstances a manufacturer, distributor, and/or seller of a product is responsible, or financially liable, for injuries sustained by a consumer who uses the product. While some of these laws generally follow the Model Uniform Products Liability Act, which is voluntary uniform products liability legislation developed on the federal level, not all states' product liability laws follow any or all of the Uniform Act's provisions. As a result, it will depend greatly on the jurisdiction in which the injury occurred in terms of the required standard of proof for an injured consumer in a products liability case, and what sort of damages a manufacturer might be responsible for if the manufacturer is found to be liable.
