Product Strict Liability

One commonly-used theory in the laws governing injuries caused by defective products is based on product strict liability. Under this theory, a person and/or company is held "strictly liable" for creating, manufacturing, distributing, and/or selling any product that causes injury or harm to others, even if they have not acted negligently, recklessly, or with any intent to harm at all. Strict liability places a lesser burden of proof on the injured party, in that the party need only show that a product was defective, and that it caused harm; the injured party is not required to show that the person or company intentionally created or delivered a defective product. Similarly, persons or companies who engage in inherently dangerous activities, such as using explosives or breeding dangerous animals, is likely to be strictly liable for any harm or injuries to another person that results from these inherently dangerous activities, since these types of activities are a risk to the general public for which the party has chosen to take responsibility.
