Product Of Liability

Product liability laws vary widely from state to state, since they are primarily based on state laws. Likewise, there are many different types of product liability claims, depending on the type of product involved, and the harm that allegedly resulted from usage of the product. In general, there are three main categories of product liability; product liability claims may be based on manufacturing defects, design defects, and/or marketing defects, or a failure of a company to warn of a product's potential harmful results. A person seeking compensation as a result of injuries suffered from using a product must allege some type of liability based on at least one of these legal theories. For instance, a consumer can argue that a toy company failed to warn consumers of the risk of electric shock to children when using a certain toy, which caused injuries to unknowing consumers. A common product of liability for a company in such cases may include recalls of the affected products, as well as monetary settlements for injured consumers.
