Product Liability Tort

Most product liability tort cases are determined solely by state law, as there is no comprehensive federal statute that governs products liability, although there are some federal regulations and legislation that does affect consumer product safety standards. There is, however, a model uniform product liability act for use by the states, but this act is simply a suggestion, and no state is compelled to use the act. Whatever state your injured occurred in, you must prove that the product that caused your injuries was defective in some way. This could take the form of a design defect, a manufacturing defect, or a simpler marketing defect. While design defects exist from the very inception of the product, manufacturing defects occur when something goes wrong during the manufacturing process to create some defective products. Marketing defects occur when a company fails to warn consumers about a potential danger of the product, or do not give appropriate instructions regarding the product so as to allow the consumer to avoid injury or harm from the product.
