A person who has suffered injuries as a result of using a particular product can prove that the product is defective in three major ways. First, the person can show that the product had a design defect, or a defect that exists even before the product is ever manufactured. On the other hand, a person can also show a product is defective in that a defect was created during the manufacturing process. In this case, while many of the same products may be without defects, some error occurred during manufacturing that caused at least some of the products to be defective in some manner. Finally, a product can be defective in terms of its marketing. For instance, if a company fails to warn that a product could cause injury if used in a certain way, or fails to warn of a particular danger of using the product. In any of these cases, a manufacturer and/or distributor of a product might be liable if the consumer can prove that the product is defective through product liability litigation.
