Product Liabilities

A manufacturer of a defective product has liabilities, or financial responsibilities, in terms of injuries or harm that results from consumer usage of the product. In very general terms, if a consumer is harmed by using a product in its original condition for the purposes for which it was intended to be used, then a manufacturer may very well be liable for the injuries or harms that occur. In some states, the consumer need only show that the product was defective in some way, or caused an unreasonably dangerous risk of harm to the consumer. If this is the case, then the manufacturer is automatically liable for the injuries, which is called strict liability. In other states, however, the consumer must prove that the manufacturer was negligent in order to recover damages for being injured by the manufacturer's product. In this case, then, the consumer must not only show that the product was defective, but that the manufacturer acted negligently, or with careless disregard for consumers' safety in manufacturing or otherwise producing the product in question.
