Under any state’s products liability law, consumers filing product lawsuits involving a particular product have the burden of proving that the product was defective in some way. Usually, a product is alleged to be defective due to its design, its manufacture, or marketing. Some defects are inherent in a product, and were clearly unintentional by the product’s designer. Other defects relate to the manufacturing process; in these cases, the product differs from other products of its type in that something occurred differently during the product’s manufacture for it to turn out differently than other products manufactured in the same manner. In these cases, the manufacturer is responsible for the injuries or damages created by the defect, no matter how many safety standards or precautions were taken to avoid such defects. Finally, some companies market products in a manner that is dishonest or fraudulent. By failing to warn consumers of inherent defects and known dangers of a particular product, companies can be liable for any injuries that result.
