Negligence Product

Under some states' laws, a manufacturer's negligence as to its product can result in liability for any injuries that result to consumers who used that particular product. Negligence generally means that a manufacturer acted negligently, or carelessly, with respect to the manufacturing, design, and/or marketing of a product, which caused injury to a consumer in some way. In other states, however, products liability laws carry a standard of strict liability, which means that a manufacturer is liable or completely responsible for harm that results from consumer use of a product, whether or not the manufacturer was negligent in any way. In this case, the consumer need only show that the product is defective; the manufacturer's intent or precautions are largely irrelevant to the cause of action. Strict liability, as a matter of social policy, is the most common legal standard underlying products liability law in the United States, but negligence may come into play in some jurisdictions and some situations, as well.
