A manufacturing defect is pretty much what it sounds like – a mistake made by a manufacturer during the manufacturing of a product. These defects are regarded as unintentional by the manufacturer, in that the manufacturer did not purposely manufacture a defective product. Typically, there is only a small percentage of manufacturing defects in a particular group of products that were manufactured according to the same plan. No matter what precautions a manufacturer takes in order to avoid manufacturing defects, however, a manufacturer is liable for any manufacturing defects that might occur, and cause injury to the consumer. It does not matter how careful the manufacturer was during the manufacturing process; essentially, the manufacturer is liable for its manufacturing defects without being at fault in any way. The policy behind strict liability in terms of manufacturing defects is that companies will take more safety precautions if they know that they will be liable for any such defects.
