Manufacturer Defect

One common type of products liability case that may involve a manufacturer defect is injuries resulting from using medical product or device. These cases tend to be a bit different from other products liability cases in some respects, at least. For instance, all products liability cases have strict time limits, or statutes or limitations, in which claims can be filed; these time limits differ according to state law. In cases involving injuries stemming from medical devices or products, however, there can be months or even years between the time that a consumer uses a medical product, and the time that the consumer discovers the injury from the medical product. As a result, there can be problems with underlying products liability claims in these types of cases. Additionally, injuries caused by medical products can sometimes qualify as products liability cases, medical malpractice cases, or both, in some situations. Therefore, you should be sure to consult an experienced attorney in order to determine which body of law governs your case, keeping in mind that there are typically totally different standards and rules for each of these types of cases.
