Legal Product Liability

When a person is injured as result of using a consumer product, the issue of legal product liability for the injuries immediately comes to mind. Who should bear the costs of injuries from using a consumer product? In American society, the trend is largely toward manufacturer and/or corporate responsibility for defective and/or unreasonably dangerous products. The social theory is that the average consumer does not have the funds or expertise to ensure that each and every product that he or she uses in a given day is completely safe for use. The consumer needs to be able to rely on consumer products to be safe and free from defects. Furthermore, this theory places pressure on manufacturers of products to take all necessary safety precautions and safeguards in order to make their products as safe as possible. Finally, as a practical matter, manufacturers can pass along the costs of complying with safety regulations and standards in the development and manufacturing of their products to consumers by adjusting their prices to account for these increased costs of production.
