Defective Products Liability

While individual consumers can consult attorneys about their legal rights to compensation for injuries that they have sustained as a result of using specific consumer products, reporting defective products to the U.S. Consumer Protection Safety Commission ("CPSC") also can have a substantial impact on preventing future injuries and/or harm resulting from other consumer use of the product. When CPSC receives a report of injury from a product, either from a medical professional or an injured consumer, it investigates the report in order to determine whether the injury was an isolated incident, whether the consumer was using the product in the manner intended, and whether the product was altered in any way before being used. If it appears that there is a significant risk of harm or injury from using the unaltered product in the manner intended, then the CPSC will notify the manufacturer of the product, and work with the manufacturer to remedy the situation. In many instances, this can result in the total recall of the affected products, which effectively removes them from the market, and prevents further injuries as result of the product.
