As is the case in the United States, Canada's product liability laws are designed to promote consumer safety and place responsibility on product manufacturers to take safety precautions in developing and manufacturing new and existing products. Similar to other industrialized countries, product liability law is constantly changing as market production changes and the use of technology grows. For instance, it is only fairly recently that Canadian provinces have adopted comprehensive class action legislation, as well as policies and laws regarding the awarding of punitive damages for violations of Canadian products liability laws. In this regard, Canada, like many other countries, has consistently moved away from individual consumer responsibility for harm or injuries that occur from using a product, and toward corporate responsibility for manufacturing and distributing safe products for consumer use. Increasingly, Canadian legal counsel not only represents consumers in product liability claims, but also works with companies and manufacturers in order to minimize their liability by properly warning consumers of the risks of using certain products through appropriate labeling, for example.
