Hundreds of consumers across the United States have suffered a loss of their sense of smell due to the use of the drug Zicam, manufactured by Matrixx Initiatives. The company has recalled all of their products that deal with Cold Remedy Nasal usage by the consumer because they have been found to cause a loss of sense of smell. Matrixx Initiatives had to settle 340 cases regarding consumers losing their sense of smell back in January of 2006. It cost Matrixx Initiatives $12 million in legal fees and $12 million in settlement payments because of the drug Zicam’s side effects. Zicam has been in production since 1999, with the company selling over 10 million bottles of all variations of the product. The Food and Drug Administration released a warning about the Cold Remedy Nasal products in June of 2009 and it was followed by a voluntary recall by the company of all nasal products with the Zicam label attached to them.
Reasons for the Lawsuit
In 2006, 340 consumers affected by the use of Zicam filed a lawsuit against the drug’s manufacturer, Matrixx Initiatives. Only one case prior to the 340-person lawsuit actually went to trial and it involved a 42-year-old Los Angeles computer consultant. The reasons for filing a lawsuit against Zicam and its manufacturer include the following:
- A loss of the senses of taste and smell which are typically irreversible
- The drug can be purchased without a prescription
- The medication is supposed to shorten the length of a common cold but it causes severe side effects
Dangers Caused to the Victim
The drug Zicam and all of its various products are not regulated or subject to the same scrutiny as other drugs because Zicam is sold over the counter and does not need a prescription to be purchased. The dangerous side effects that consumers suffer from include a permanent loss of the senses of smell and taste. Sometimes it is just taste and sometimes it is just the sense of smell that the consumer looses when using Zicam. Some cases involve consumers losing both of their senses at the same time. Consumers can lose their sense of smell or taste after one use or after a prolonged use of the drug. These are the main dangers caused to the victims of the drug Zicam.
